These Terms of Use ("Terms") govern your access to and use of https://appliedsilver.com (the "Site"), operated by Applied Silver Inc, doing business as Applied Silver ("Applied Silver," "we," "us," "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About the Site

The Site is provided for general informational purposes. It describes Applied Silver and its products, allows you to contact us, and allows you to subscribe to communications from us. The Site is not a sales channel, and no order, contract, or supply obligation is created by your use of it.

2. Product Information and Claims

Applied Silver's antimicrobial products, including SilvaClean, are registered with the U.S. Environmental Protection Agency. The following applies to all product information on the Site:

  • The approved label governs. Statements on the Site are general descriptions and are not a substitute for the EPA-approved product label. Always read and follow the label. Use of the product in a manner inconsistent with its labeling is prohibited by federal law.

  • Availability varies by state. Registered antimicrobial products must also be registered in each state where they are distributed or sold. Products described on the Site may not be registered or available in all states.

  • No warranty of results. Performance data, case studies, and testimonials on the Site reflect specific conditions and are not a guarantee of results in your facility. Nothing on the Site constitutes a warranty, express or implied, regarding product performance.

  • Not medical advice. Nothing on the Site is medical, clinical, or infection-control advice, and it should not be relied on in place of guidance from qualified professionals or applicable regulatory requirements.

3. Intellectual Property

The Site and its contents — including text, graphics, logos, images, video, and the selection and arrangement of that content — are owned by Applied Silver or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Applied Silver, SilvaClean, and associated logos are trademarks of Applied Silver Inc. You may not use them without our prior written permission.

You may view, download, and print Site content for your own internal, non-commercial reference. Any other use — including reproduction, modification, distribution, republication, or creation of derivative works — requires our prior written consent.

4. Acceptable Use

You agree not to:

  • Use the Site in violation of any applicable law or regulation

  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems

  • Introduce malware or any other harmful code

  • Use automated means to scrape, harvest, or collect information from the Site, including contact information, except as permitted by our robots.txt

  • Interfere with or disrupt the operation of the Site

  • Submit false, misleading, or third-party information through our forms without authorization

  • Use the Site to transmit unsolicited commercial messages

7. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Site or its servers are free of harmful components. We do not warrant the accuracy, completeness, or timeliness of Site content, and we may change it at any time without notice.

This section does not disclaim any warranty that cannot be disclaimed under applicable law, and it does not affect any separate written warranty provided with a product purchase.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, APPLIED SILVER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Applied Silver and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

10. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Arapahoe County, Colorado, and you consent to the jurisdiction of those courts.

11. Changes to These Terms

We may revise these Terms at any time. When we do, we will update the "Last Updated" date above and post the revised Terms on this page. Your continued use of the Site after a revision takes effect means you accept the updated Terms.

12. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Applied Silver regarding your use of the Site.
